Terms of Use

These Terms of Use (“Terms”) form a legal agreement between you and the developer (“we”, “us”) governing your use of the SubRadar mobile application (the “App”). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, solely for your own personal, non-commercial use, in accordance with the Apple Media Services Terms and these Terms.

2. Acceptable Use

You agree not to: (a) copy, modify, reverse engineer, decompile, or create derivative works of the App except to the extent this restriction is prohibited by law; (b) rent, lease, lend, sell, or sublicense the App; (c) use the App to break any law or infringe anyone's rights; or (d) interfere with or attempt to gain unauthorized access to the App or its related systems.

3. Subscriptions and Purchases

The App may offer auto-renewable subscriptions and other in-app purchases. All purchases are processed by Apple through your App Store account, and the following apply:

4. Intellectual Property

The App and its content, features, and design are owned by the developer and its licensors and are protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.

5. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

6. Limitation of Liability

To the maximum extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App in the twelve months before the claim, or USD 50, whichever is greater.

7. Apple as Third-Party Beneficiary

These Terms are between you and the developer only, not with Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any App maintenance, support, and warranty claims are our responsibility, not Apple's, to the extent required by the Apple Media Services Terms.

8. Termination

These Terms apply until terminated. Your rights end automatically if you breach them. You may stop using the App and delete it at any time.

9. Governing Law

These Terms are governed by the laws of the jurisdiction where the developer resides, without regard to its conflict-of-laws rules. Mandatory consumer-protection rights in your country of residence are unaffected.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect means you accept the revised Terms.
